Terms and Conditions

PREAMBLE

The following clauses govern participation in events organised by Motomonster GmbH & Co KG (hereinafter referred to as the organiser).

I. General

Participants must be proficient in operating their vehicle and must not be under the influence of alcohol (zero blood alcohol level) or any substances that impair their ability to ride when starting the event. The motorcycle must be suitable for its intended use and in full working order. Noise emissions must not exceed the limit specified by the circuit operator.
The organiser has authority over access to and conduct on the circuit; all instructions must be followed.
Before taking part, participants must sign the express liability waiver (www.motomonster.de/dl/Haftungsverzicht-2014-small.pdf).
At the start of the event, the organiser will provide a comprehensive briefing for all riders; riding on the circuit without having attended the briefing is prohibited.
Participants who do not meet these requirements will be excluded from participation without entitlement to a refund.

II. Booking

The booking becomes binding upon receipt of the organiser’s booking confirmation in text form (email).
Participants may cancel their booking free of charge up to 90 days before the start of the event.
For cancellations up to 60 days before the start of the event, 75% of the participation fee will be refunded; for cancellations up to 22 days before the start of the event, 50% will be refunded. No refund will be given for cancellations made after this.
Participants may nominate a replacement participant to avoid cancellation charges. In this case, we will refund the full booking amount less €25.
We recommend taking out the trip cancellation option.

If the organiser cancels the event before it begins, participation fees already paid will be refunded promptly; participants will not be entitled to any further compensation.
If the event is cut short, the participation fee will not be refunded where this is due to circumstances for which the organiser is not responsible.

Please note: If you have booked a training event, your booking confirmation will tell you when payment is due and where to send it. Our payment deadline is usually three months before the training event. If we have not received your payment by then, we reserve the right to offer your place to a participant on the waiting list.

III. Limitation of liability

The organiser accepts no liability for personal injury, financial loss or property damage that participants may suffer during the event. This limitation of liability does not apply in cases of wilful misconduct or gross negligence on the part of the organiser or its employees.
Each participant is personally liable for any damage they cause to the circuit or to other event participants.

IV. Minors

Minors may generally participate provided that written consent from their legal guardians is supplied at the time of booking, the booking is made by those guardians, and the minor is accompanied to the event by a legal guardian or another authorised adult. The contracting party is the person with parental responsibility.

V. Transponders

We provide participants with a timing transponder for the duration of the event free of charge. In the event of destruction, loss or failure to return the transponder, the participant agrees to reimburse MotoMonster for the replacement cost of the transponder, amounting to EUR 500.00 (including 19% VAT).
In the event of a late return, the participant agrees to pay a flat fee of EUR 10 (including 19% VAT) per day, starting on the seventh day after the event and continuing until the day we receive the transponder.

If the transponder is partially damaged, the participant agrees to reimburse the organiser for the repair costs.

VI. Miscellaneous

Any commercial activity in connection with the event is prohibited; this applies in particular to advertising or sales.
Waste must be disposed of in accordance with the rules applicable at the respective circuit; participants who breach these rules must bear any resulting costs.
Participants consent to photographs and video recordings being taken of parts of the event; the organiser may use this material for its own purposes (advertising). Where a participant is individually identifiable, they may object to the use of the material at any time.

VII. Written form requirement / Severability clause

Any departure from these terms of participation may only be agreed in writing on a case-by-case basis; this also applies to any waiver of the written form requirement.
If any provision of these contractual terms is invalid, this will not render the terms as a whole invalid.

IMPORTANT NOTICE:

The event is not governed by the rules applicable to public road traffic. In particular,
property damage generally does not give rise to any entitlement to compensation under another participant’s liability insurance.
We recommend taking out insurance covering damage to your own vehicle, personal accident insurance and liability insurance, each of which must cover participation in the event.
