Disclaimer

Participants take part in the training event(s) at their own risk. They bear sole civil and criminal responsibility for any damage caused by them or by the vehicle they use, unless an exclusion of liability has been agreed.

The undersigned waives all claims of any kind for damage arising in connection with the training event(s) against:
The organiser, marshals, circuit owners, circuit operator, public authorities, racing service providers and all other persons involved in organising the training; the agents and persons engaged to perform obligations or tasks on behalf of any of the aforementioned persons and bodies; the other participants and their assistants; the owners and keepers of the other vehicles; and the undersigned’s own passenger, rider and assistants.

This waiver does not apply to damage arising from death, personal injury or damage to health resulting from an intentional or negligent breach of duty, including such a breach by a legal representative or a person performing obligations on behalf of any of the persons covered by this exclusion of liability. Nor does it apply to other damage resulting from an intentional or grossly negligent breach of duty, including such a breach by a legal representative or a person performing obligations on behalf of any of the persons covered by this exclusion of liability.

This exclusion of liability takes effect in relation to all parties involved upon submission of this declaration. It applies to claims on any legal basis, including, in particular, claims for damages arising from contractual and non-contractual liability, as well as claims in tort. Any implied exclusions of liability remain unaffected by this exclusion of liability clause.

The legal representative(s) of a minor declare(s) that they are aware of the particular additional risks generally associated with minors’ lack of experience and that they bear sole responsibility for supervising the minor during the motorcycle training. They declare that they accept the above exclusion of liability on behalf of the minor they represent.

By signing, riders, passengers and legal representatives confirm that they are aware of the insurance cover in place for the training event.
This exclusion of liability remains valid indefinitely for all MotoMonster events. It may be revoked before each event. Actual participation in an event constitutes a waiver of that revocation.

Written form requirement / Severability clause
Any departure from the above provisions may only be agreed in writing on a case-by-case basis; this also applies to any waiver of the written form requirement. If any provision of these contractual terms is invalid, this will not render the terms as a whole invalid.
